Disclosure and Privacy Agreement:

This Disclosure and Privacy Agreement (“Agreement”) is entered into by and between McDevittFitCoaching (Ethan McDevitt) and [Client Name] , collectively referred to as the “Parties.”

1. Purpose

The purpose of this Agreement is to protect the privacy of the Client and establish the terms under which the Coach may or may not use the Client’s personal information, photographs, and progress materials for testimonial or marketing purposes.

2. Privacy of Information

a. All personal information, communications, and materials shared between the Client and the Coach (including but not limited to health history, fitness progress, photographs, and other personal data) shall be kept strictly confidential.
b. Such information will not be disclosed, sold, or shared with any third party without the Client’s express written consent, except as required by law.

3. Use of Photographs and Testimonials

a. The Client has the option to opt in or out of allowing the Coach to use their beginning and/or progress photographs, testimonials, and results for promotional or educational purposes.
b. The Client may indicate their preference below:

• ☐ I DO consent to the use of my photographs and testimonials by the Coach for marketing, advertising, and promotional purposes.

• ☐ I DO NOT consent to the use of my photographs and testimonials by the Coach.

c. The Client understands that if consent is given, their name and/or identity will only be disclosed if the Client provides additional written permission. Otherwise, photos and testimonials may be used anonymously (e.g., first name only or blurred/covered face).

4. Right to Withdraw Consent

The Client may withdraw consent to the use of their photographs and/or testimonials at any time by providing written notice to the Coach. Upon receiving notice, the Coach will make reasonable efforts to remove the Client’s content from future promotional materials. However, the Client understands that materials already published or distributed cannot be recalled.

5. Term

This Agreement shall remain in effect for the duration of the Client’s coaching relationship with the Coach, and sections regarding privacy and confidentiality shall survive termination of services.
